Terms of Use
Terms governing access to and use of KAFRA Capital software.
1. Scope
These Terms govern access to and use of KAFRA Capital, a software platform for investor reporting, performance tracking, and transparency. KAFRA does not execute trades, take custody of client assets, or make investment decisions on behalf of users.
2. Access and accounts
Access may be granted only after review and acceptance by KAFRA Capital. Users are responsible for keeping their login credentials secure and for all activity carried out through their account.
3. Subscription
KAFRA Capital is intended to be offered on a monthly subscription basis. Applicable pricing and subscription details are presented or agreed before a paid subscription begins.
A two-week free trial may be offered once the service is fully ready and stable. KAFRA may change or discontinue a trial offer before a paid subscription starts.
4. Cancellation
A paid subscription may be cancelled at any time. Unless otherwise agreed, cancellation takes effect at the end of the already paid billing period, and access remains available until that date.
5. Refunds
Fees are generally non-refundable. An exception may be considered where the contracted KAFRA service is demonstrably non-functional or materially unavailable for reasons attributable to KAFRA. Any refund is assessed on the circumstances of the case.
6. Acceptable use
Users must not misuse the service, attempt unauthorized access, interfere with the platform, circumvent security controls, or use KAFRA for unlawful purposes.
7. Availability and data
KAFRA aims to provide reliable reporting and transparency functionality but does not guarantee uninterrupted availability or that third-party data connections will always operate without interruption.
8. Intellectual property
KAFRA Capital and its software, branding, design, and original content remain protected by applicable intellectual property rights. Users receive a limited right to use the service during the applicable access period.
9. Liability
To the extent permitted by applicable law, KAFRA Capital is not responsible for losses arising from trading decisions, investment decisions, market movements, broker failures, third-party services, or data supplied by external systems. Nothing in these Terms excludes liability that cannot legally be excluded.
10. Governing law
These Terms are governed by Swiss law, subject to mandatory provisions that may apply to a user based on applicable law.
